German prosecutors are preparing to drop all the most serious charges against the only man convicted for the 11 September attacks, because they fear that crucial American evidence was obtained by torturing detainees.

Afraid to get their hands dirty, and petulantly punishing the US which has, they're about to let this guy go with time served, most likely. Presumably this is to teach us a lesson about how to conduct a war. They don't understand that it's very early, and things are going to get much worse before they get better.

'In Germany, any use of force to produce a statement is unlawful,' said [defense attorney] Graessle-Münscher. 'After Abu Ghraib, if the Americans want to see Motassadeq convicted for 9/11 they are going to have to prove both Binalshibh and Mohammed are in good health, and that they say Motassadeq was a conspirator.'

Apparently the prosecutors agree.

This war is being conducted, among other places, in the streets and mosques of the West. Defendants have the advantage in Western criminal courts, so it is foolish for us to move battles to that arena. Sadly, it's not only Germans who've made this elemental strategic error.

It's comforting to believe that we're only facing a criminal gang best dealt with in the courts and that the law will protect us. 9/11 has not convinced enough people that this is a false hope. Unfortunately more convincing is needed and I have no doubt that it will be supplied. But it should not have been necessary.

Haunted by the Japanese internment, and by Hiroshima, Nagasaki, and Dresden, a good portion of the West has decided that any defense of the US and the West must be conducted strictly on the up-and-up, legally, and respectably enough to earn the UN stamp of approval. This will allow us to feel good about ourselves and our system. That won't be enough to win.
